Defective Product Zofran Has Been Shown to Cause Birth Defects
Zofran (ondansetron) is a medication that is prescribed to prevent vomiting and nausea. Zofran works by blocking serotonin, a neurotransmitter, in the brain that triggers vomiting and nausea. The FDA approved Zofran in the treatment of nausea and vomiting in patients undergoing chemotherapy or radiation therapy for cancer treatment. It is also approved for post-surgery nausea symptoms.
In the past Zofran has been prescribed to pregnant women in “off-label” use for nausea and vomiting. Doctors can prescribe medications as off-label treatment if they think that the benefits outweigh any risks. But the drug company, GSK, that makes Zofran can not legally promote the defective product for this off-label use.

In 1999 GSK had been warned by the FDA for not properly representing possible drugs risks associated with Zofran. Then in 2012 GSK paid out $3 Billion to settle a suit that accused them of marketing Zofran illegally leading to many birth defects.
The $3 Billion settlement did not release GSK from continuing liability for injuries from using Zofran.
