KCRA3 reported that on July 22, a vehicle crossed the center line and crashed into another vehicle on Empire Ranch Road between Woodhead Street and Broadstone Parkway. According to law enforcement, it is unknown at this time why the driver crossed the center line; however, there are many reasons why a driver leaves their lane and crashes into another vehicle.
Two children were transported to the hospital from the accident scene by helicopter. A woman and another child were transported to the hospital by an ambulance. Although the extent of the accident victims’ injuries is unknown, reports state that all victims were responsive and speaking with rescue crews during transport.
Head-on Car Accidents
There are many reasons why a head-on car accident occurs, including but not limited to:
- A driver enters a road, interstate, or highway on the wrong side of the road causing a collision with traffic headed in the correct direction;
- A driver loses control of the vehicle due to a mechanical malfunction such as brake failure or defective tires;
- Distracted driving due to cell phone use, eating, grooming, texting, and other distractions; and,
- Adverse weather conditions such as rain, hail, high winds, and fog.
Regardless of the reason why a driver may cross the center line causing a head-on collision, the fault for the accident typically rests with the driver who crossed the center line. In most cases, the insurance company for the at-fault driver must pay the accident victim’s damages including medical expenses, lost wages, property damage, emotional suffering, mental anguish, and physical pain. However, the accident victim must first prove that the other driver was at fault for the collision and that the victim suffered damages as a result of the collision.
Proving Liability in a Head-on Collision
Take these three steps after a head-on collision:
ONE: Call the Police. Always call the police and wait for the police to arrive. You want the police to investigate and to file a report if you are not at fault for a collision. However, the police can get things wrong at an accident scene; therefore, try to get as much information as you can at the scene, including but not limited to:
- Pictures of the accident scene;
- As much information about the other driver and the vehicle as possible; and,
- Names and contact information for eye witnesses.
TWO: Seek Medical Attention. Your health should be your number one priority after a head-on collision. You could be suffering from an injury you may not be aware of right after the collision. Do not risk your health by delaying medical attention. Furthermore, you need to document your injuries for your accident claim.
